Safe and effective methods of preconception gender selection through flow cytometric separation of X- and Y-bearing sperm could greatly increase the use of gender selection by couples contemplating reproduction. Such a development raises ethical, legal, and social issues about the impact of such practices on offspring, on sex ratio imbalances, and on sexism and the status of women. This paper analyzes the competing interests in preconception gender selection, and concludes that its use to increase gender variety in a family, and (...) possibly for selecting the gender of firstborn, might in many instances be ethically acceptable. Família e escola são os dois primeiros contextos de desenvolvimento afetivo, cognitivo e social da criança. As experiências vividas nos contextos familiar e escolar interferem nas aprendizagens escolares. O objetivo deste estudo foi investigar os efeitos das relações afetivas familiares no desempenho escolar de alunos do Ensino Fundamental I e conhecer quais orientações são dadas a professores diante de alunos com problemas de aprendizagem ocasionados por afetos negativos nas relações familiares. Foi realizada uma revisão bibliográfica integrativa de artigos científicos nas (...) bases de dados SciELO, PePSIC e BVS-Psi, utilizando-se o operador booleano AND e os descritores “relações familiares”, “desempenho acadêmico”, “desenvolvimento infantil”, “problemas de aprendizagem” e “afeto”, “interação pai(s) e filho(s)”, “motivação”, “parentalidade”, “empatia”, “rendimento escolar” e “aluno”. Foram adotados como critérios de inclusão: artigos publicados entre 2012 e 2022, em português, disponibilizados gratuitamente on-line e na íntegra. De 11.557 artigos encontrados, após aplicação dos critérios de inclusão, foram selecionados 80 e, destes, cinco contemplaram os objetivos deste estudo. Os dados foram analisados por meio da análise de conteúdo e apontam que a relação afetiva familiar positiva apresenta consequências positivas no desempenho escolar; as relações afetivas familiares negativas afetam negativamente; e que não são dadas orientações a professores sobre como lidar com alunos com problemas de aprendizagem, devido a problemas nas relações afetivas familiares. Observa-se que novos estudos devem ser desenvolvidos, considerando-se as lacunas identificadas no acervo selecionado. (shrink)

La collecte et l'utilisation efficace des données clients constituent un enjeu stratégique et éthique majeur pour les entreprises. Depuis les années 1990, l'arrivée des NTIC est venue bouleverser la manière avec laquelle ces données sont collectées, stockées puis utilisées. Ces pratiques ne s'opèrent pas sans que les consommateurs y trouvent à redire, considérant souvent celles-ci comme une intrusion dans leur vie privée. Ce phénomène est prégnant sur Internet qui présente un environnement dans lequel les menaces sur la vie privée sont (...) renforcées. De plus en plus d'internautes ont dès lors pris des mesures pour se protéger, y compris des restrictions sur leurs échanges d'informations et leurs achats en ligne. Ce constat invite à mieux comprendre les réactions des consommateurs face à la collecte de leurs données personnelles sur Internet. Les résultats de nos enquêtes montrent un écart entre les protections offertes par le droit et les perceptions des consommateurs à ce sujet. Ils confirment aussi un écart entre les intentions déclarées et les comportements réels. Des recommandations visant à inciter les acteurs à adopter des pratiques éthiques dans ce domaine sont présentées.The collection and efficient use of customer data is a major strategic and ethical issue for companies. Since the 1990s, ICTs have brought radical changes in the way these data are collected, stored and used. Most consumers see these practices as an intrusion into their private life. The phenomenon pervades the Internet, an environment where threats to privacy are increasing. More and more Web surfers have consequently taken measures to protect their privacy, for example by restricting exchanges of information and online purchases. This observation has prompted a survey aiming to gain a better understanding of consumer reactions to the collection of their personal data on the Web. The results of our investigations show that the legal privacy protection does not match consumer perceptions in this regard. They also confirm a difference between declared intentions and actual consumer behaviour. The concluding recommendations are designed to promote ethical data use among companies. (shrink)

El cuidado de la reciprocidad y de la imparcialidad es fundamental en la tradición de la filosofía liberal. Las teorías liberales y solidarias de la justicia aspiran a establecer un acceso igual a las oportunidades y a los recursos a todos los individuos dentro de la comunidad. Sin embargo la dificultad principal que se encuentra reside en la determinación y la identificación de los recursos pertinentes que se debe tomar en cuenta. Ahora bien el análisis demuestra que ni el enfoque (...) de Rawls sobre los bienes primarios ni el de Dworkin, apoyado en una subasta de las dotaciones tan internas que externas, convienen. ¿Cuál es desde entonces el enfoque lo mas satisfactorio? ¿Debemos revolver al de la igualdad del bienestar como el análisis, propuesta por Roemer, de la posición de Dworkin le sugiere? ¿Debemos privilegiar el punto de vista de la igualdad de las ?realizaciones sociales fundamentales?? Las teorías liberales igualitarias de la justicia, las cuales otorgan a la igual solicitud una importancia crucial, afrontan un buen número de cuestiones cuando consideran qué bienes deberían ser distribuidos prioritariamente. Las implicaciones y perspectivas de estas teorías dependen de su definición del tipo de recurso que privilegien, tal y como veremos mediante un análisis de la teoría rawlsiana de los bienes primarios, de la teoría de la igualdad de recursos y de la teoría de la igualdad de oportunidades. Este (...) análisis mostrará que no es posible descartar la dimensión del bienestar en la evaluación de las situaciones individuales, tal y como han pensado las concepciones igualitarias de los recursos. L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

Plus qu'un ouvrage concernant les rapports ombrageux et controversés de l'art et de la pathologie, ce recueil est d'abord une rencontre, un creuset entre des champs, la clinique et la théorie qui, pour s'y confronter, excèdent les limites du " prêt-à-penser ". C'est pourquoi ici les divergences de méthodes et de perspectives entre des approches phénoménologique et psychanalytique ne dressent pas de strictes délimitations, mais font résonner des dissonances capables de laisser penser l'écart entre l'art et la pathologie comme établi (...) sur une entr'appartenance plus essentielle, ne livrant rien de son secret à celui qui s'en tient à des distinctions de principe. Encore faut-il entendre pathologie en son sens grec, au sens où la rencontre avec le monde ouvre, dans le réel, une brèche incolmatable dont seul l'art peut authentiquement rendre compte et dans laquelle la psychose s'engouffre si aucune mise en œuvre ne vient l'endiguer ou la ressourcer. " Aussi ne faut-il pas s'étonner que penser l'art et penser la folie puissent converger dans la mesure où ni l'un ni l'autre ne sont conceptualisables. Finalement, penser l'art ou penser la folie, c'est avoir ouverture à eux, à travers les œuvres, à travers les êtres malades et cela n'est possible précisément que dans une rencontre. Qu'est-ce qu'une rencontre? C'est cette situation qui n'a pas d'antécédent, qui n'a pas d'espace ni de temps qui puisse la précéder. L'épiphanie de quelqu'un dans le regard d'un autre implique nécessairement l'autophanie de celui-ci. L'échec de la rencontre, récusant tout passage lucide à l'ouvert, rejette le thérapeute sur sa facticité. C'est pour se dérober à l'épreuve sans partage de cette absence de soi, que la psychiatrie médicale, scientifico-médicale fait l'impasse sur la présence de l'autre, en objectivant tout ce qui touche à l'homme, en faisant de lui un cas particulier de cette objectivation universelle qui est la caractéristique de la culture de notre époque. Objective: To explore the strategies that can help individuals mourning a family member’s death from Covid-19 to cope with the loss. Method: We carried out a narrative review on the PubCovid-19 platform using the descriptors “death,” “mourning,” “Covid-19,” and “coping strategies.” Ten articles were included. Results: The strategies found are phone calls, audio recording, letters, and photos, classified as immediate and long-term. These strategies are focused on mental health, which can be adversely affected by depression and psychological disorders. Conclusions: Creating (...) counseling programs for the relatives of those who died from Covid-19 is urgent. They must offer comprehensive, humanized, and continuous mental health care. (shrink)

Chacun s’interroge sur les effets de la séparation de couple sur l’enfant. Dans la mesure où il module les relations familiales après la séparation, le mode de garde semble être une variable centrale. Pour y voir plus clair, nous nous sommes intéressées à la période de la post-adoles-cence, qui voit le développement du second processus de séparation-individuation (Blos, 1967). Nous avons rencontré 29 jeunes femmes de 18 à 23 ans et analysé, par une série d’outils cliniques, la manière dont chaque (...) mode de garde a pu moduler l’individuation de ces sujets par rapport à leur famille. Chacun d’entre eux semble bien avoir un effet différent sur les dynamiques d’emprise et de dégagement propres à la post-adolescence, ainsi que sur la qualité des relations de l’enfant à son père et sa mère. La question cosmopolitique est restée en marge de l'intérêt qui a été porté à la pensée juridico-politique de Kant. Mais l'intérêt philosophique de la question cosmopolitique dépasse très largement ce cadre. Elle atteste d'abord que la théorie politique de Kant ne se limite pas une théorie de l'Etat. Il doit y avoir un en deçà et un au-delà de l'Etat, où la politique dépasse l'idée de peuple pour atteindre celle d'humanité. En ce sens, Kant est l'antidote de Carl Schmitt, qui (...) portait en lui la haine de l'idée cosmopolitique. Cet antagonisme théorique entre Schmitt et Kant, entre le poison et le remède, est largement attesté dans ce volume. Ce qui montre à quel point nous avons besoin aujourd'hui du cosmopolitisme de Kant, pour penser le passage de la guerre à la paix, la place de l'hôte étranger dans nos sociétés complexes et la nouvelle configuration d'un monde globalisé. If, as many suppose, pornography changes people, a question arises as to how.1 One answer to this question offers a grand and noble vision. Inspired by the idea that pornography is speech, and inspired by a certain liberal ideal about the point of speech in political life, some theorists say that pornography contributes to that liberal ideal: pornography, even at its most violent and misogynistic, and even at its most harmful, is political speech that aims to express certain views about (...) the good life, 2aims to persuade its consumers of a certain political point of view—and to some extent succeeds in persuading them. Ronald Dworkin suggests that the pornographer contributes to the ‘moral environment, by expressing his political or social convictions or tastes or prejudices informally’, that pornography ‘seeks to deliver’ a ‘message’ , that it reflects the ‘opinion’ that ‘women are submissive, or enjoy being dominated, or should be treated as if they did’, that it is comparable to speech ‘advocating that women occupy inferior roles’.3 Pornography on this view is political speech that aims to persuade its listeners of the truth of certain ideas about women, and of course ‘the government must leave to the people the evaluation of ideas’.4 Another answer offers a vision that is not grand and noble, but thoroughly reductive. Pornography is not politically persuasive speech, but speech that works by a process of psychological conditioning. This view seems common enough in the social science literature. Consider, for example, this description of an early experiment, from a time that pre-dates contemporary political debate. (shrink)

The much-commented prologue of Jean Renart's Roman de la Rose is a rich source for literary speculation, and it is unlikely that successive generations of critics will ever exhaust its many interpretive possibilities. Jean himself, active in the first two decades of the thirteenth century, remains an enigmatic figure: critical agreement makes him the author of three works, the Lai de l'Ombre, in which he names himself ; the Roman de l'Escoufle, attributed to him on account of allusions to the (...) first work and stylistic similarities; and, lastly, what is now most commonly called the Roman de la Rose. Jean emerges playfully from within the lines of his works: humor and ingenuity appear as his trademarks, and are more revealing of his character than the one extant reference to his name. The following analysis explores but one small aspect of Jean's creativity and narrative engin. Beginning with a reading of the prologue, and a consideration of the status of lyric insertions in the romance, I will contend that the amount of clothing exchanged in the Roman de la Rose and the extraordinary concentration on it render this work highly unusual and that it has potential as a metaphor for the intricate textual exchange inherent in the circulation of poetry. In short, a matrix of imagery concerned with fabric and clothing highlights the status of lyric insertions in the text. The argument will be that the exchange of clothing in the romance echoes the circulation of song: robes, mantels, and tunics are the material correlatives of the various kinds of song that adorn the text aurally as the clothes do visually. While it might seem improbable at first, Jean's prologue plants the idea with his analogy of textual composition to cloth production. (shrink)

Psychologists say a measure has construct validity when it, in fact, measures the construct it is intended to measure. Construct validity is both an important notion in psychological research methods and the source of much confusion and debate among psychologists. I argue that this confusion arises, in part, because of a failure to distinguish between construct validity, a feature of measures relative to a construct, and construct legitimacy, a feature of the construct itself. I propose a prescriptive account of construct (...) validity on the basis of this distinction, then provide evidence for my account through two examples from research psychology. (shrink)

In this paper I outline an “agent-centered” approach to learning ethics. The approach is “agent-centered” in that its central aim is to prepare students toact wisely and responsibly when faced with moral problems. The methods characteristic of this approach are suitable for integrating material on professional and research ethics into technical courses, as well as for free-standing ethics courses. The analogy I draw between ethical problems and design problems clarifies the character of ethical problems as they are experienced by those (...) who must respond to them. It exposes the mistake, common in ethics teaching, of misrepresenting moral problems as multiple-choice problems, especially in the form of ‘dilemmas’, that is, a forced choice between two unacceptable alternatives. Furthermore, I clarify the importance for responsible practice of recognizing any ambiguity in the problem situation. (shrink)

Among the available metaethical views, it would seem that moral realism—in particular moral naturalism—must explain the possibility of moral progress. We see this in the oft-used argument from disagreement against various moral realist views. My suggestion in this paper is that, surprisingly, metaethical constructivism has at least as pressing a need to explain moral progress. I take moral progress to be, minimally, the opportunity to access and to act in light of moral facts of the matter, whether they are mind-independent (...) or -dependent. For the metaethical constructivist, however, I add that moral progress ought also mean that agents come to be or could come to be motivated to act in light of the right kind of moral judgments. Together I take this to mean that, for all forms of constructivism, moral progress must be explained as a form of moral improvement, or agents aspiring to be better sorts of moral agents. In what moral improvement consists differs for various forms of constructivism. Here I distinguish between three different versions of metaethical constructivism: Humean constructivists as represented by Street, Kantian constitutivist constructivists as represented by Korsgaard, and constructivists about practical reason as represented by Carla Bagnoli. I conclude by showing that only constructivism as a view about practical reason can fully account for moral progress qua the opportunity for moral improvement. (shrink)

Unlike some other reproductions of classic texts (1) We have not used OCR(Optical Character Recognition), as this leads to bad quality books with introduced typos. (2) In books where there are images such as portraits, maps, sketches etc We have endeavoured to keep the quality of these images, so they represent accurately the original artefact. Although occasionally there may be certain imperfections with these old texts, we feel they deserve to be made available for future generations to enjoy.

Writing and that which it entails are the subject of countless texts by Maurice Blanchot. In particular, Blanchot has focused on the notion of the work, or more precisely on a groundlessness or an absence of the work, which he has designated from different perspectives over the course of more than half a century. In various ways, Blanchot has conceived of the work as an affirmation of its undoing. The question of narration, often about a confrontation with death, is fundamentally (...) important, as is evident for example in Blanchot’s Death Sentence, The Madness of the Day or The Instant of My Death. In a sense, it is bound up with the possibility of the work. Writing about Henry James in “The Turn of the Screw” 2 in The Book to Come, Blanchot discusses narration. What is described is indeed a certain absence of the work relating to the writer’s difficult struggle to narrate everything. I will examine Blanchot’s reading of James to expose this conception of narration centred on seizing the truth. It is apparent that Blanchot approaches the question very differently in “Narrative Voice ,” in The Infinite Conversation in which there is a decentring of the work. 3 I will show that this text as well as certain writings by Derrida make it possible to arrive at a conception of narration in Henry James’s The Turn of the Screw which strongly contrasts with the one put forward by Blanchot in The Book to Come. Thus, alongside Blanchot’s reading of The Turn of the Screw which relates to the project of realising the work as a totality, Blanchot makes possible a more radical approach to the text, illustrating the non-totalization of the work whose borders are uncertain. In this way, Blanchot can be shown to step beyond an impossible conception of the absence of the work. (shrink)

In this paper, we present an ethical and strategic approach to managing organizational crises. The proposed crisis management model (1) offers a new approach to guide an organization’s strategic and ethical response to crisis, and (2) provides a two-by-two framework for classifying organizational crises. The ethically rational approach to crisis draws upon strategic rationality, crisis, and ethics literature to understand and address organizational crises. Recent examples of corporate crises are employed to illustrate the theoretical claims advanced.
